Hi

I went through a very 4 and a half year long divorce, the house got transferred to me via the consent order, the mortgage is in joint names however the order states I’m fully liable for the debt and I also took on a joint bank loan & again am fully liable for making the payments.

I was order to transfer my shares in the family business to my ex husband by the 12th of May which I did in mid April ( the business was one of the many things offset against my equity in the house transfer )

He was ordered to pay the business overdraft - again was in joint names taken out in 2009 ( he removed me from our family business and falsely told companies house I’d resigned) and he was also ordered to transfer the property to me by 12th May.

He never transferred the house as ordered and I’ve now sold it to release him from the mortgage and start afresh on my own, I’ve had to take it back to court as he’s refusing to sign the conveyancing paperwork, another order was issued stating he had to pay the court costs by 16th July and sign the paperwork by the 12th July, otherwise the judge will sign on his behalf.

I have also been now chased by the bank regarding the overdraft as he’s not paid that either and have now put an urgent application in for contempt of court. I have fully liaised with the bank and they have given me a months grace to sort this out.

I have two dependent children and only work part time, and really struggle but kept up with all my liabilities as per court order. I also receive no maintenance as he’s self employed and is declaring he’s earning less than £7 a week running two businesses working 6 days a week.

He lives with his partner and is engaged to be married, he transferred all his business assets to her during the divorce ( another reason I got the house equity)everything they have brought since being together is in her name !!

The sealed court order had a penal notice attached.

Any advice on how this contempt of court regarding the business overdraft will be dealt with will be much appreciated

Thanks
