thank you yogasun the wine will be given with the meal and not sold . the five pound cost of the event would not even cover our costs. would i still need a licence and where from at what cost

I dont know if tis of any use to you, but my sisters local italian resturant does not have an alcohol license, so when you go for a meal, you take your own alcohol! Bottles of wine or whatever it is you want!

The Licensing Act 2003 simplified the process of getting what used to be known as an 'occasional licence'. You now simply have to file a 'TEN' (= Temporary Event Notice) with your local authority. (Unless you live in an area covered by a unitary authority, licensing matters are dealt with by the district or borough council, not by the county council).

Simply print out this form

complete it and make 3 copies. Keep one copy and send one copy to your local Chief Constable. Submit the original, plus one copy, together with a fee of �21 to your local authority's licensing officer. The authority will endorse one copy and return it to you, as an acknowledgement of receipt.

Note that you aren't asking for a licence. You're simply carrying out your obligation to notify the licensing authority about the event. (i.e. there's no 'application'' involved and, consequently, you can't be refused).

Hi, what if you ask for a donation of �5.00 and so you are not actually selling anything to them.

The point is that authorisation is required if alcohol is sold by retail. If you are asking for donations of �5 in order to provide someone with alcohol, this is a sale. If people have the option of saying no, but still get alcohol, it may not be, it depends on the circumstances. There are many aspects of the law which you may infringe. Your choice seems to be get an authorisation by way of TEN for �21 or do not provide the alcohol.
