ebay shopping & my rights

I ordered a laptop on ebay through an ebay shop.

I then got an email from ebay to say that my order had been cancelled because my account was suspended without me realising it.

I emailed the ebay shop and they said that I can't cancel and it will be dispatched tomorrow. I don't want it and I don't have the funds.

When I ordered the laptop I set up payment through paypal and I can't cancel.

I really need some advice. The ebay shop is very unhelpful

Please help me. I need advice with regards to a refund and how I can send it back.

If you buy anything from a UK supplier "at a distance" like via the internet, you have the legal right to return it within a few days of receiving it for a full refund.

Ebay suspended your account and cancelled your order but say you can't cancel? Ebay suspended my account after the bid went through so my order was automatically cancelled. Although the ebay shop continued with the order.

Seeing as you seem so well versed in the distance selling regulations you will also be aware that they do not apply to licensed software.

Considering that not have you only bought a laptop but you have also bought all the software installed on the laptop the distance selling regulations do not apply in this case as you have bought a package which we described in the listing. Now should you wish to return the laptop for a refund it will be so at the returns details stated on the listing.

The thing you need to concern yourself with is has the company got your money from paypal, or not.

If not you won't be getting any goods.

as far as I am aware the only provision made for software under the distance selling regulations is that it must still be sealed if a refund is to be given.

as you have not received the software (or the computer) I would assume you have not opened it!
