ipod touch update (3.0)

hi i have the newest update for the ipodtouch (2 gen) ad i am encountering a few problems like when it has been turned onto sleep for more than 5 mins then you wake it back upagain you cannot access the settings menu in turn not being able to join the internet. if you restart it then you can and get on the internet. does this mean i need to restart it every time i want to go on it, is there anything i can do and any news about another update as this might correct it. cheers

That certainly doesn't happen with me (though I have an iPhone).

Try connecting your iPod to iTunes, then running the restore function.

Seems like something has gone a bit a-miss.
