I think I have found my answer - in 2003 a couple sold a house and said there were no ongoing disputes with the neighbours which was a lie - there has been years of antagonism and arguing over boundaries which had never been resolved; the buyers sued the sellers for �67,000. However - a lawyer commentating on the case stated that has the buyers refused to answer questions about the property - there would have been no come back, though obviously it might raise doubts with the buyers. Thank you for your responses, though I could do without the sarcasm from the prev respondant - it is a perfectly acceptable question, as we all know the law is an ass.
