My partners estranged wife filed for divorce last Feb, my partner agreed to the proceedings (no kids or property) and sent off his paperwork to the courts. After weeks of chasing we discovered she still had not sent her court papers and affidavit back to the court for the decree nisi, the excuse was she was suffering from depression and could not bring herself to sign the paperwork. Her solicitor eventuallt sent the paperwork to the court at the begining of January, now we have just heard that the divorce has been thrown out and from what we can gather there was a problem with her paperwork. This has now cost my partner hundreds of pounds because his solicitor has had to chase things up. He has now decided that he wants to strike out her divorce and file for it himself, otherwise this could continue for months. Is it possible for him to do this and is it worth him doing a quickie divorce on line, they have been separated more than 5 years. I did my divorce myself on line and it was quick and hassle free (maybe I was one of the lucky ones). Do you think there is any chance my partner could claim some of these monies back due to the incompetance of his ex's solicitor.
but you can get the forms for free and fill them in yourself. they're not going to represent you should that be necessary and it seems that site only deals with uncontested divorces.
hi sarah, yes thats what he was going to do, as neither of them are or should I say were contesting the divorce when she was the applicant, maybe if he issues proceedings she may contest, though i don' no for what reason she may do, but if he downloaded the forms and filled them in and sent them to her, if she then decided to be awkward, he could then instruct a solicitor to continue, would this be possible
