Opposite my drive.

We live on an estate & the road the traffic runs two ways, the person opp parks his small van on the pavement directly opp our drive, our neighbour parks his car just forward than his drive as his drive has another car parked in it, I always reverse into our drive, but on reversing many a time the front end of my car has come close to getting hit by passing cars due to the van, is there a highway law to look at due to this obstruction? I would be grateful for any help.

There is an offence called "causing an obstruction". There are lots of rules in the Highway Code about parking. Read the HC and check which rules are being broken, then talk to your neighbourhood police volunteers first. If they can't help, try traffic wardens, then the Police.

In addition, parking a motor vehicle on a footpath adjacent to the public highway is an offence.

Thanks Buildersmate, this person does not seem to have much Common, I've had a word with him before regards this problem, I stated if my car gets hit he will pay the damage costs but its like talking to the wall, I know alot of us park or stop on pavements, I've done it myself. Cheers.

Is there another junction close by- perhaps a side road coming off your road? I recall that there is some restriction on parking within so many metres (10m?) of a junction.

There is a Junction but not that close.

its not really an obstruction though is it?...as you can get in and out of your drive...
if the passing motorists are too impatient to wait until you have performed your manouvre before passing, that is hardly your neighbours fault...

i am also not sure how he is causing an obstruction to the road if he is on the pavement...

he is entitled to park his van.

it sounds like you just would like a bit more space in the road than you are entitled to...
