There was a similar case some years ago involving the Bluebell Railway - a heritage line in Sussex. In 1997 the owners of the "Thomas the Tank Engine" franchise - the Britt Allcroft Company - attempted to sue the Bluebell Railway for using the name "Stepney" for one of its locomotives. Stepney was the name given to a character loco in the series. The railway politely pointed out that the locomotive they owned had acquired its name when it was built in 1872 - some 39 years before the Reverend Wilbert Awbrey (the creator of "Thomas the Tank Engine") was born. I don't think they heard any more:
