On the condition that the genial colourpoint was not to be used for breeding, also if she decided not to keep it, then it must be offered back to her first, an agreement was duly signed by both seller and buyer. My friend has now learned that the buyer is a breeder of Persian cats, and that she has indeed had five kittens produced from my friends kitten, the buyer was confronted but at first denied any wrongdoing .......then an advert was seen adverting the kittens for sale , when Again confronted she admitted she had in fact had kittens from my friends colourpoint cat, but then said "you can't do anything about it anyway !!!! The agreement was a supplied by the governing council of colourpoint breeders. Any advice would be appreciated.

Sorry to tell you that such agreements are not worth the paer they are printed on. An animal is seen as a chattel and if it exchanges hands for money, including a compulsory donation to a rescue, then title passes absolutely to the buyer to do as they wish.

PS i know more about digs than cats but at the kennel club, the breeder can put a limitation on registered pups that snt progeny are not registerable. It doesn’t stop the new owner breeding but stops the pups being registered at the kc

In which case the governing council of colourpoint breeders has a few questions to answer.

oh I doubt it OG....I bet they don’t offer the format with any guarantee as to its legality.... Its not illegal to make people sign them if they want the animal and many dog rescues who require a donation for their animals make people sign similar agreements, and most adopters believe they are enforceable. They don’t often get as far as the courts but the few that have, have found in favour of the owner/buyer/adopter of the animal. Anecdotally I believe that the few that have come to court have been as a result of the rescue harassing the adopter when they refused to abide by the agreement or return the animal.

Doesn't help your friend regarding this problem, but to stop future kerfuffles, has your friend considering selling on her kittens already neutered?
