I have purchased one of these hand held vacuum cleaners because my two Shar Peis have started moulting, but it doesnt do the job.

Cant take it back to Argos because the dirt bag inside no longer looks new and it wouldnt be fair to do so.Any suggestions what to do next ? should I write to Dirt Devil ? has any one else got one and what do they think of it ?

Doesn't matter if the bag is dirty,if it is still under the 12months guarantee and doesn't do what it is supposed to do i.e. pick up pet hairs then I would take it back.You have to have used it to find out that it doen't do the job properly.If Argos won't change it then I would definately write to Dirt Devil.You have nothing to lose.Good luck!

Quite right, valsuey, it has to be fit for the purpose it was sold for (I think the phrase is 'of merchantable quality'). Clearly, Dee Sa doesn't think it is (and since she bought it, she's the judge), therefore she's within her rights to return it. Forget about the bag being dirty, DS, they'll just put a clean one in when they check it over and repackage it.

Fit for purpose is a very loose term in regards to a vacuum cleaner. If it picks up, then it works. The question is one of interpretation and therin the burden of proof lies with you.

However Argos has a 28 day returns policy. You can return boxed items (technically unused, but nobody at Argos will check) within 28 days of purchase for any reason and they will refund your money.

I shouldn't think Argos would bother to repackage anything returned, it wouldn't be worth their while for what it would cost. That is why you get so many 'Argos Returns' stalls on markets - and why you should always check that things work or only buy things that you can see are ok.
