Tree/Bush
2 Answers
We have a very established tree/bush near the boundary fence in our garden. When we moved into the Bungalow last year the nieghbour said that "we dont have the bush higher than the garage wall" and proceeded to prune the whole bush down to approx 5 foot. This was ok until he built a loft conversion in his roof. Now he has a birds eye view of our garden and property. We have decided to grow this bush a little higher to gain privacy and we have told the niehgbours this is what we want. They continue to cut down the bush which is clearly on our side of the boundary wall. I have no object to them cutting down any overhanging branches but they are cutting down the whole bush. Do I have any rights?.

Check with a lawyer. first interview is usually free. No joy there? threaten to plant leylandi conifers further into your garden. These can grow to 20+feet tall after a few years and your neighbour will have to trespass if they try pruning them
Sorry Caramba, but I must disagree with you about planting leylandi - v.dodgy, and a sure fire way of making enemies out of your neighbours.
The neighbours however have no right to prune your tree other than the parts that overhang their property (and then by law they're meant to return the cuttings to you - otherwise it would technically be theft believe it or not). Unfortunately, as with so many problems of this nature, its very difficult to settle the issue amicably and you obviously don't want to fall out with your neighbours. Have you thought about putting a fence up to regain some of your privacy?
