My Daughters dad and I share exactly 50/50 custody, and I claim DLA and the Child Benefit for my daughter as she has learning difficulties. Her dad claims Childrens tax credits. On my application of DLA last year, I was advised by the Citizens Advice that if we streamlined the 3 claims, then we would qualify for Disability Tax Credits as we were entitled to DLA. Dad had loads of problems trying to get the tax credits, as he was not in receipt of the Child Benefit, and no matter how he tried to explain it to them, they could not seem to grasp we shared custody. Anyhow, to make things simple he wants me to claim for all/any entitlements soley in my name. But when one stops claiming tax credits, they quite often are hit with an overpayment, so can anyone advise how to avoid this? Also, we are trying to get taxi travel for my daughter to get to and from school whilst at her Dad's as his working hours do not fit around the school hours, and he does not have private transport. I can take my daughter to school from my house no problem as I have a car and my working hours fit around her school times on my days, but on the days she's at Dad's I'm having to travel to his (I live 23 miles away from him) and do the school run both in the morn and afternoon. Whilst my work have been fine about my coming in late & running out in the afternoon, it's not a long term nor practical arrangement. I was just wondering that if he 'claimed sole responsibility' lies with me, could the council refuse to supply a taxi for the days she's with Dad? We're not trying to diddle anyone, we're just trying to make the whole thing a bit simpler!

I think what they are talking about is the disability element of tax credits.

If he ends his claim with tax credits on one date and you claim the next day there will not be an overpayment.
