Hi me and some friends where out drinking and one of them got accused of racial abuse, police arrived but the victim now was not willing to press charges, police then proceeded to give a section 27 to leave city centre. We left the area and attempted to leave city centre (which we believe we did) friend stopped to roll a cig police then pulled up and said he was in breach of section 27 and manhandled him into van even tho he put up no resistance. Once he got back to station they had change the charge to drunk and disorderly. My problem with this is his physical and mental state had not changed since the issuing the section 27 we had no verbal or physical contact with anyone whilst leaving the city centre, we had committed no crimes after the issuing of the section 27 so how can they charge him with D+D when he has complied with what he was requested to do? When I have looked this up on the Internet and on police forums they seem to dislike the section 27 as it is easily challenged as most peeps are drunk when issued them, so the police seem to prefer to use D+D as its harder to challenge in court and you can be given a £80 fine. But can they arrest you for one then change it to another?

As you have been told it is perfectly normal to arrest on one charge and then summons on a diffrent charge. The arrest is just the means to get you to the police station to look more closely at the facts.
