County Court Cancelled - What Can I Claim Back For?

As some of you may be aware of a ludicrous claim i mentioned on here a few times
(please look back through my posts, to see the various posts about the history of this case)

She has now sent a crowing nasty email laughing and saying she has dropped the case - and only did it to 'teach me a lesson' for not picking the parcel up ... hahaha!

I believe she has only said this - because i informed her that i had evidence that she had already received the money from the parcel company, so now her claim of being out of pocket no-longer stands.
i think she really thought she could win the case.

its a long story - but i have loads of evidence of her *** behaviour, lies and evidence that the whole thing - of sending out a broken parcel, intending to switch it - was a scam from the start - I believe that any judge reading it all would agree that none of it makes sense, and is very suspicious - also her admission that she has abused the court system - just for the hell of it.

so, i am thinking of making a claim back to her now - so what could I possibly claim for?
obviously solicitors costs, travel to the solicitors, phone calls - what else?
Pain and suffering?

is there anything I can do with all the evidence i have about her sending out an already broken parcel with the intention of swapping the item - I am pretty sure any judge would agree with me etc -

also is there anything can be done with her confession of it all just being to annoy me? (not sure i believe that because it costs money to make these claims - so a bit of a stupid thing to do) -
i mean its not annoyed me that much!! - irritating sure, but i've not lost any sleep over it haha!

PLEASE NOTE - i may not bother to do this - i can't really be arsed - but if i realistically can get some cash off her for this, then i will - she deserves for this to cost her something

if I cannot realistically get anything, can anyone tell me some things i could just tell her in an email that i will be claiming for - give me some legal jargon etc to make her think she will be in trouble in court and she may end up having to pay me money

thanks

You are well rid of her, just get over it and carry on as normal. legally I do not think you can do anything. You made the mistake of overreacting in the 1st place , you should have just stuck to a simple 2 sentence rebuttal of her ludicrous claim to the county court. Just asking her for compensation is hardly going to work is it?
well done you !
it is a worry to have a ludicrous claim
and costs money

since you were in the small claims - I think nothing. each side stands their own costs unless the other side has behaved unreasonably -which she hasnt she has rationally realised she cant win

And you cant sue someone because they have sued you.
basically a case cannot of itself beget a case which is ( the case haha) here.

You're in a word screwed

I am not sure that a crowing email shows malice

sorry - but good news really

can i not claim solicitors costs though?

or at least tell her i'm going to?

just so she worries for a bit
Just take the moral high ground and ignore her, put it all behind you and look forward to summer.
Question Author
i mean what if i'd spent loads of money on solicitors and travel and phone, an she has now said it was all for spite?

Question Author
no, i want to *** her off and make her worry.

i know i should just ignore her, but i'm not going to

Don't try to spite her back. Show her you are the better person, take the advice given to you and move on. good luck.
Can you tell us this idiots eBay name so we can make sure we never do business with her?
Question Author
can anyone tell me how much this will have cost her to claim?
I know to issue the forms its £25

but i read somewhere there is a fee also for the directions questionnaire - which i think it said £40 ... would she have had to pay that first in order to have the directions questionnaire sent to me, or only when she sends her own back?
I suspect she may have just not returned hers, or cancelled it before?

I would like to know if she has spent £65 or £25 'teaching me a lesson' ...haha
you got a solicitor involved????
Question Author
oh god no, but she doesn't know that ... i want her to think she may have to go to court after all - but pay me instead
ok, then you run the risk of her thinking "well if i'm going to get stuck with these fees, i may as well carry on with my case against her" and find it re-opened again!
aren't you self - employed? Perhaps you could say you are going to charge her for lost jobs?
