Breaking contract - leaving before notice period.

As many of you know we’ve handed in our notice (I say “our” as Husb n I are in a joint
role)

Our contract stated 3 months notice on either side and we requested to leave early (a 2 month notice).

The employer is refusing - tho they have not responded to us (verbal or written). the refusal has come via another source ( I saw it in writing myself - don’t ask how I’d rather not divulge lol). They have not even acknowledged our Resignation email

I’m tempted to just walk after the 2 months is up. We have another role to go to which wants us ASAP- …

Thoughts?

Cant see them sueing you but it will mean youve burnt your bridges if things dont work out with new employer
they might be awkward and withold the pay for the last month your there (month 2 of notice period) but my guess is they'll just let it drop.

Yes it’s burning bridges that is my concern - may need refs in future etc

I just don’t understand it esp as there is now someone who will fill in for the most important aspects of our role.

I can only think it’s stubbornness…. But we’ve always got on well with employer, Gone the extra mile etc etc etc

If you gotta go then go but leave everything in the best shape possible and leave detailed handover notes for the boss and new employees. Maybe write down the duties the new person can cover straight away and the ones they need to find another way to cover

Yes good points Bob. I’ve been making handover sheets and finishing off stuff in the meantime. Even thinking into next years season getting estimates etc for works anticipated. Don’t want anyone to be able to point fingers later (not that we’d know of course )
Just a thought but if your employers haven't responded to you then they haven't refused your request as far as you officially know.

Nope I saw (don’t ask me how - I’d rather not divulge!) an email from employer to someone else saying it. Black n white - but not to us :(

i fear there might be some awkwardness with your living arrangements though as you live in?

No that’s taken care of as new role also has sep accom - ( this sort of job does) we also own a place in wales
Could they ask for rent though for last month if you leave within the notice period
Has your line manager or equivalent not acknowledged that you're leaving? Not even the 'official' three month end date? Are they not making handover arrangements?

If not I'd be following up pronto.

No unlikely. As we don’t pay rent as such - the role always needs live in (it’s insurance requirements) and… the person whose taking over part of our role is keen to move in and start ASAP.

I just don’t understand it.

So in other words they’d never rent out this staff accom - they are too private to have tenants so close to main manor and I think security wld concern them

I don’t want to leave with bad feelings - but I suspect the simple fact that we resigned may have annoyed them.

Still the above quandary going on - I hate conflict - and these sort of things worry me (incessantly) Im becoming quite anxious tbh!

So to date no response re our request to leave before official notice period.

Its been 5 weeks since we verbally resigned, 2 weeks since we backed this up in writing and tonight I plan (??!!!) to send an email saying that as we have not hear we WILL be leaving XYZ date (we have accepted another job )

A synopsis:
our notice period is 3 months (in our contract)
we requested 2 months
We have had no response whatsoever


HOWEVER ... I saw an email (not addressed to me so I can't let slip!!!) wherein employer sent their lawyer (I kid you not!) an email saying "I'm mindful to refuse their request". (in other words a no).


Lawyer responded saying that they can't stop us leaving early but they can threaten us with a poor ref (PS up until resignation we had had nothing but good praise from employer!). Its left a bad taste in my mouth tbh because we've always got on well - even though we rarely saw employers due to their lifestyle / various homes elsewhere etc

PS there is someone ready to step into the most important part of our role with immediate effect and I've done handover sheets etc etc etc

I can only think that the employer does not like to be told what to do?

in short I gotta get it over with - I know that. conflict avoidance is stressful - once done I can relax. Husband on the other hand is so black n white (aka decisive) he has been ready to send this email for ages!

I know all the above makes me sound juvenile - and honest I can (and do!) make important decisions surrounding work - Just hate leaving under a cloud - esp when I have no idea WHY?!

Has your line manager or equivalent not acknowledged that you're leaving?// she just keeps saying its up to employer (but manager is extremely gormless anyway )
