can the council block off our drive?

we have been using a small piece of council land to turn our car onto our drive, they have now decided to put posts in around this land making it impossible for us to park our vehicles on our front drive and making it very difficult to turn onto the drive next to our house, they have told us to buy the land for �1500 or they intend to post it off. I know it s their land but feel they are being bullish about this. Do they have the right to block us off or do we have the right to use the land as access/right of way?

I live in a house with a council owned green outside our house. I need to drive on this patch of grass to get on to my drive or i would have to park down the street. If they fenced off this green all hell would break loose from me! Don't stand for it! Alert the local papers etc, do whatever you can, don't let beucracy win!!
If I drove over your garden would you be ****** off. I think so. The land belongs to the council so why would you have the right to drive over it. You don't say wether the land is grass or tarmac. Around here they are making people that park or drive on the grass pay for the damage.
Yes they can do this and you have to pay for the kerb to be dropped if necessary as they have to grant a right of passage..
I'm all for challenging things but the council have the law behind them in this case
consider moving the opening of your drive in the garden wall to enable you to get in another way - be cheaper than �1500

Thanks to everyone who answered something that they don't understand. The council built these houses like this and built driveways on to our properties. The person before me purchased the property off of the council and we purchased it off of them. Why then would the council say that we can not drive on the grass on to the properties that THEY built with the driveways THEY provided? Believe me I know a lot more about government then you lot ever will. I have a degree in government and politics and my grandad is an MP for an independent party, so don't come off all high and mighty with me!
Also loosehead, give me your name, address and car reg and i will be happy to remind you of everything you drive on that doesn't belong to you. Everytime you pull up on to the kerb to pop into the shop, everytime you think you own the road and moan about other drivers and pedestrains and don't lie to me and say you don't coz you obviously do you patronising ****!

joko am i living in a council house? No! Am i council scum? No! I have had to buy my house for a large amount of money which me and my husband have to work hard for. I didn't know it was a council house until I had already put an offer in and had my surveyors report in hand, even then i didn't really give a ****.

Its a pity you've ended up taking a swipe at virtually everyone who tried to provide an answer to your question. Several of these people contribute much to this site.
If you own this piece of land in question because your seller bought it off the council then there's no problem. If it is part of the highway in that it is a footpath, you may be able to get access and put a dropped kerb at the road-edge for a price - maybe that's what the �1500 is your refer to. If the land is neither yours nor part of the highway it almost ceertainly is owned by the Local Council. In which case I'm afraid they are within their right to fence it off.
I'm sure with your background, I'm not telling you anything new here, but the Highway and Local Council-owned land are NOT the same thing. Are you OK with that?

Still olympic level ignorance like yours cannot be corrected. You "know more than I will ever know", yeah right oh!. You see, perceived knowledge is inversely proportional to actual knowledge. The more you know the more you know you don't know, and conversely in your case when you know very little you think you know everything! "Degree in Government and Politics" - not Law then? Because the two are completely different.

By the way, 4 years is generous, I'd say 3 was more like it, and the first year doesn't count anyway, so more like 2. Probably 10 hours of lectures a week for 30 weeks a year - that's about 3 months of real work!

My point was if you are so clever and qualified and know everything, why do you live in what was once a council house?
Surely with your huge head you are earning a fortune and would surely have purchased a large 'fancy' house, not a council house, because whatever it used to be, the council don't tend to build large elegant mansions for their "council scum"
