I have just got off the phone with a friend. She is desperate for her husband to leave the marital home and kids as he is threatening and nasty, has been for over 12 years. He won't go. What rights does she have?

If his behaviour is also having a serious effect on the children, this is an added reason for her to take action now. I don't know whether your friend works, but if her husband is forced to leave the marital home, he will obviously have the additional expense of maintaining a separate roof over his head and this could well mean that he will either be incapable or unwilling to continue supporting her and the children financially. She needs to think about how she will cope in this situation and if possible, try and prepare herself to cope with.
