Waiting for a CPS decision (Edit)
Back in september, I had an accident. The police told me that they were investigating me for dangerous driving although the accident was due to a vehicle fault. Unfortunatly, tests came back saying there was no fault but I am adamant that there was. I havent heard anything since december, although the police had told me that the case had been passed to the CPS. Is this usual? Am I to asume that there will be no charges? Its kind of hard to get on with my life at the moment but Im too scared to ring them and find out.

After nine months of waiting for CPS to make their minds up about what they're going to do, I got a call today from my solicitors who have said that CPS are waiting for a report from the vehicle manufacturer. It seems that they are going all out to prosecute me.
My solicitor has suggested that I may have hit the accelorator instead of the brake. This stems from the mechanics report. Although this is possible, I am adamant it didnt happen and dont want to admit to something that Im not 100% about. It also seems that CPS are going to go with this theory too.
Im more worried about this than ever because I have read about people still going to prison for this mistake. Afterall, it is a mistake made out of panic in the end.
Any one have any advice because Im very worried. I am a lonedad to a 9 month old and Im scared about what will happen to her if they send me to prison.

Your right in that dangerous driving does often result in custodial sentences. There are two things you should hang on to though:
1. Mitigation does go some way to influencing a sentence, and assuming you are of previous good character then the fact that you are a single dad could land you with a community penalty or suspended sentence.
2. Get a good solicitor. If you were plead not guilty to dangerous driving, the CPS may accept a guilty plea to the lessor charge of due care which would land you with a non custodial sentence. Good luck.

I received a summons today for the offence of driving a mechanically propelled vehicle dangerously on a road contary to section 2 of the road traffic act 1988 and schedule 2 of the road traffic offenders act 1988. What does all that mean?
I cannot remember a time that I was more terrified than i am now. I have tried so hard to be on the right side of the law all my life. I honestly didnt drive that vehicle dangerously or without due care. I wish cps would believe me.
