My sixteen year old sons x girlfriend has recently informed us that her seven month old daughter is my sons baby, after the initial shock we had a DNA test proving her to be so. the problem is another lad has being going out with her since early pregnancy and has raised the child as his since her birth. His name is on her birth certificate as she informed him the baby was his.
He has had doubts and has now left her.
So my question is who has parental responsibility my son or the other lad. also the babys mother is refusing to have the birth certificate changed to her own or our surname.how do we stand legally on that matter.

I think the main thing in all this is the baby's welfare and making sure they are being well loved and cared for and trying to come to an amicable arrangement as possible for the child to be looked after and financially supported before sorting details such as the birth certificate.
If not married to the mother then your son does not have automatic parental responsibility but can obtain it.

given you have dna evidence to prove paternity your son needs to apply to the courts to be appointed guardian of the child and also will need to apply to have his name inserted on the birthcert.
as stated above the priority is the childs welfare. Does your son plan to play a parental role young and all as he is.

By the way, if another lad has been going out with her since early pregnancy It seem she is not to worried about who she sleeps with.
This is getting so common in the UK and no doubt she will be on free benefits, house etc for the rest of her life like the rest of unmarried Mothers..
