failure to check car
14 Answers
Hey
My girlfriend recently purchased a car from a well known garage and after owning the car for just 4 days the passengers front wheel fell off. Thankfully the car was only doing 5mph otherwise the results for the my girlfriend and her 3 friends in the car at the time could have been much more serious. The car supposedly passed an MOT on the 18th of january and the garage have since admitted that it was MOT'd at another branch and only the lights and fluid levels were checked the the garage we collected it from. They have agreed to fix the car free of charge and have provided my girlfriend with a rental free of charge for the time being. However if anyone has any ideas on the best way to persue for compensation I'd loce to hear them as they can not get away with this.
Thanks

TBH it sounds like the inconvenience is minimal as they have given her a car to drive while they are fixing hers. Mental anguish sounds a bit OTT to me - if you can show is has caused her great mental anguish i could understand - could you give us an example of what mental anguish she has suffered, and how much money you think will compensate for that.
Ok so her wheel fell off but no-one was hurt, didn't cause a crash etc. it hasn't left her unable to drive - she is driving a rental car.
ok i can see it is inconvenient for her but surely it's only a temporary inconvenience that she will get over?
Anyway all that ^^^ is only my opinon of course, and ive never had it happen to me so what do i know? If she has legal cover on her car insurance, could she talk to them? If not, you are looking at a solicitor and once you go that way, no-one wins except them

This question is a prime example of why we all pay more taxes, high premiums and extra costs.
Those that are apart of the compensation culture deserve all the misfortune they got in the first place. Scum of the earth.
'(she)now hates the idea of getting in a car' - take the hire car back then
mental anguish - for a wheel falling off? If she suffers from mental anguish that readily she shouldn't be on the road.
Sh** happens mate. Tell your girlfriend to get over it and stop trying to fleece us all.

If you want to pursue this, expect your girlfriend to be subjected to any number of medical and psychological tests both now and in the future and examination of her previous medical history. She'll have to show serious trauma, not just the kind of thing that suggests 'pull yourself together, don't be such a wuss' or 'let's see how much we can get out of an insurance company on some trivial pretext' (which is the attitude she's going to encounter ).Doctors and courts are cynical and insurers even more so.
I'd say it's a non-starter on what you say.

I agree she should get compensation.. HAD AN ACCIDENT OR INJURY been caused... but nothing happened...
What are they compensating for?
Mental trauma - oh get over it!
She's driving the hire car.... so assume she can still drive...
Im still traumatised by the lorry that pulled into my lane without indicating.. and I'm now scared of driving on motorways! Perhaps I should sue...

err...sorry but they sold her a car that was not fit for the road...it could have killed her and others... they are obviously very lax in their checks and they should not get away with it
i agree anguish etc is not enough - but they need to know they cant just churn out dangerous cars
i would speak to the cab
