Hi Guys

A little advice/suggestions if you wouldnt mind, to be honest I'm not sure there's anything to suggest as such, just a bit of moral support maybe lol.

My partner and I have finally called it a day and I feel a huge weight just been lifted from my shoulders, however I'm living in his house with his furniture, oh, he has kindly offered me the beds for my children!! However I have worked out that I need 5k to fully furnish/carpet/curtain a new place and I just havent got it, meaning I either stay here in an awful atmosphere until I can save up that amount or get a loan, do I want to start my new life with debt hanging around my neck?

When we first moved in together I sold my house and I put £36,500 into this place, about year or so he gave me £15,000 as I needed it for something but now he is saying thats all I'm due and he wont give me the rest. I cant afford solicitors fees as I may as well just save that money that I would be paying out to them or do I risk it and see if I can fight to get the rest of my money back?

He's saying that Im not getting anymore of my money as when we first got together I did have some debt and he did pay them off for me but at NO point did he state that if we ever split up he would want it back as I would have never let him pay them off and I would have carried on paying them each month as I had been doing.

Anyway, enough of my ramblings.... any suggestions?

Consult a solicitor, I would not do it any other way. You both have rights and you both need someone to tell you what they are, irrespective of who paid what in times gone by. Re the furniture etc., I bought a lot of stuff second hand when I first moved in, I couldn't afford new - the charity shops and refurb chairities were a godsend. Good luck - and I know what you mean about the relief, it's like a big black cloak lifting off your head once a decision like this has been made.
You put £36,000 into the property ... property values go up ... you end up with £15,000.

Remind me not to take investment advice from you "ex" !

Lol Jayne.. He says I OWE it to him for when he paid off my debt for me, which I never asked him to do and he never advised/suggested etc that he would want it back in the event of our relationship breaking down.

Lots of names spring to mind right at this moment in time!

Thank you for that, very informative... I have copied and pasted into a word doc to through at him when he decides to get up out of his bed and maybe just maybe start looking for a job! rather than sponging off me.

Just used the calculator and unfortunately I do earn too much to be considered for legal aid.

Hi, he's not disputing that I paid it in, just stating that he thinks that I now owe it to him, theres definately a paper trail as we discussed this with both the conveyancing solicitor (whom I had worked for previously as a legal assistant) and also the financial/mortgage advisor too!
