Plaintiff gives false evidence in court
4 Answers
2 years ago I was arrested in Spain accused of violence against a femail aquantence. The truth is that she attacked me giving me a bloody nose in my house while I was trying to remove her (she refused to leave) and by dog became distressed and bit her leg but without breaking the skin. I was bailed and later shocked to find out from my solicitor that she was claiming broken nose, broken prosthetic teeth (even though there were no marks to her face as witnessed by the police) and post traumatic stress. I was charged under art.150 of the Spanish penal code and was looking at 5 years in jail 15,000 euros compensation and court costs.
At my lawyers request I hired a private inverstigator who found out that I washer 4th person denouncement for gender violence the last of which was against a man for the same facial injuries.
On the day at court she refused to produce the x-ray of her nose and accepted that she had made previouse claims and that she was on medication for depression.
The tribunal found me innocent of all charges due to "serious doubts by the court as to weather the injuries ocurred on the night in question and that the accused was the author of same and the exraordinary revalation brought to the room that the plaintiff sent the accused text messages the day after denouncing him and asking for a restraining order against him"
In short, this woman embarked on a carefully premeditated campaign to damage me as much as possible for financial reward and in so doing caused me 2 years of absolute hell.
Could anyone tell me if I have any recourse against this woman not least to stop her doing it a 5th time to someone else.

I believe the laws surrounding perjury are more or less the same throughout the Union so if anyone can help based on UK law that may help. It seems that most court cases involve some degree of lying mainly by the accused and nothing comes of it. If no-one lied we wouldn´t need a jury! My case, however seems extreme in that false documentation was produced in the form of x-rays of old dental problems etc
Well I can't give you advice or information about Spanish law but I am sorry to hear about this, I honestly wouldn't think much could be done by yourself to stop this woman from getting another poor victim......I would (if I was you) get on with your life and not give her second thought again because she really does sound like scum - to be polite!!
Anyway, sorry if you don't find my input any use...Good luck with getting justice !!
