Cancelling An Order
I ordered a garden shed on line over a month ago. I paid with my Credit card. They took out the money on the day of the order. Since they have not delivered the goods I intend to cancel the order.
I was wondering if anyone knows the appropriate section of the Consumer Protection Act or whatever legislation covers this, so I can quote it at the Company.
This is not a small business by the way, but seems to be a large concern so no fraud involved, just very poor Customer service.
TIA

No need to go down the s.75 route - that should always be last resort.
The relevant legislation is the Distance Selling Regs:
The Distance Selling Regulations state that your right to cancel an order starts the moment you place your order and doesn’t end until seven working days from the day after you receive your goods.

You are spoilt for choice in what legislation you use but as hc4361 rightly says the distance selling regulations 2000 are probably the most suitable. If you did not agree a delivery date, the shed is not being custom made and it is not a business to business transaction the delivery is a statutory 30 days from the day after they received the order. The first time you would have the opportunity to inspect the goods would be upon receipt this is the reason you would have 7 workings days after the day you receive the goods for inspection.
You may not find another supplier can now deliver quicker than your original company, once you have telephoned them as ojread2 very sensible suggests, when/if you telephone mention you are relying on the distance selling regulations 2000, which may make them react promptly.

The order was placed on 14 th, of April and they took the money from the Credit Card on that date. They Emailed on 20 April to say that they had begun to make the shed. Since then, no Delivery date has been given. I emailed and asked for one, reminding them that their Advert promised delivery within 10 working days. They replied to say that their Advert was not intended to mislead, but it still did not contain any Delivery date. Since then no contact has been made.
I think they have had enough time to get the thing out to us. In any case circumstances have changed and we no longer need the shed.
Oh and I could get one made locally, erected within a week. Bit more expensive but................
Thank you all for your help.
