Don't see why not. Penalties for breach of contract must, in English Law, not be in disproportion to the loss suffered. You might need to word the claim slightly differently but it should still be valid.

I am prepared to be corrected but I understand that this is under Consumer Credit Law and therefore businesses are exempt.

As an example, every consumer hire purchase document must have an APR on the document - business HP doesn't have the APR on as it is not covered.
vic - although the primary legislation used to reclaim "unfair" bank charges is that for consumer credit, contract law and common law are also cited and it is those that have been successfully used in regard of business accounts.
