Think I've been scammed

Didn't really now where else to put this

On 29th March 2011 I won two tickets to see take that for Manchester on Fri 3rd June. Because the item was for a large amount of money I wanted to make sure I felt comfortable parting with my money which was £155 so I sent emails to the seller via ebay to find out as much info as possible. One of the emails i sent was asking if she had proof of purchase online to send to me before I send payment, but she couldn’t as she stated that she bought them from the City of Manchester Stadium. On 29th March she said she made a mess and needed to relist but I said could I not still have the tickets I won and she relists the other eight. She quoted back to me' sorry mate i am new to this ebay lark and made complete hash of it but i have relisted the item and have 10more to put on how many do u require?'
I responded back to let her know I wanted the 2 I won and she said that was fine and said for me to send the payment. Ever since I sent the payment she won’t answer any of my messages either via ebay or with the email I got from her.

I have since got her phone number through ebay and left a message but still no response.

I bought these tickets as treat for my Fiancée and not only does it look like we wont be able to go now but it looks like I wont get my money back. I hope I'm wrong and they still come but i'm extremely dubious now.

Paypal and ebay have both refused to help as It has exceeded the 45 day period before I contacted them to open a dispute.

I need help as to what to do from here to get my money back. I'm gutted.

I'd like to give you hope but I too found ebay and paypal less than useless when I was scammed. And the police who were put on the case never bothered to feed back so I assume they just sat on their arse.

I hope you have better luck than I. Maybe they will get back to you eventually.

As this looks like a clear case of theft I would imagine you could contact the Police, Ebay and Paypal will need to furnish the Police with all the details when requested.

My answer isn't going to be too hopeful I'm afraid - as paypal and ebay have washed their hands of it I really don't see what you can do. I hope someone else has more positive news for you - and there are very switched on people on this forum so don't give up hope just yet!

Have you tried contacting other ticket buyers (look at the seller's other feedback) to see if they have received their tickets?

Time barring is something one really always needs to watch out for, but I still think it is poor of PayPal and eBay to disown the situation, and credit cards apparently refuse to take responsibility because PayPal are the party they look to and PayPal did not fail to carry out your instructions. I would think the thing to do would be to take out small claim action in your local court or (if convenmient) the court nearest to the seller's address. The problem is that the address given by the seller is very possibly false. Additionally, it is worth while discussing this with your local police because this may be part of a very large scam already being investigated by police at local or national level. If you used a credit card then speak to them also. If it is at all feasible for you you might consider going to the seller's address to confront her with your complaint - although that might simply confirm a false address, that the seller has given a false name, that it is really a he who is behind all this and simply used a girfriend's, sister's name (or completely ficticious). You should try to pass on the story to a fraud unit, especially in the locality of the address used by the seller. Good luck.

did she say she had the tickets in hand? generally, tickets aren't posted out by suppliers until a week or so before the event.

have you contacted your credit card company to see if you're covered?

With respect that is a joke isn't it?

The Police don't prosecute in respect assaults and burglaries most of the time and if you go to them with an ebay issue they will laugh at you.

Treat it as a lesson learnt and never ever buy tickets off Ebay again

thanks for responses. I'm not going to give up. She said at the time she queued up outside city of manchester stadium for them so I'm going to contact them to see what I can find out.
Thing is I'm not sure how much information they can give out because of data protection.

No, you said she had other tickets for sale, go on to her feedback list and you will be able to contact anyone else who bought form her, I've done it before myself.

That unfortunately was your first mistake. Regardless of where she bought them she would have had some sort of proof - email for a start. The last time I read about ticket sales on eBay the seller HAD to have the tickets, the ACTUAL tickets in their possession in order to sell them and it is not allowed to sell a 'proof of purchase'

OP, I just read that she queued outside the stadium for them - so she could have taken a photo of the tickets for you then, couldn't she? I think you have fallen hook line and sinker I'm afraid

theres alot of it going about,
my sis in law was scammed when she 'bought tickets' online, (not ebay) for her and my brother to go and see peter kay, as a christmas present for him.
she paid alot of money out for them too... :o(
