outstanding debt

i have been contacted by a collection agency.the letter states that i owe a sum of£456 on a littlewoods catalogue account.i rang the collection agency and told them i did have a catalogue account but i thought i had cleared it
they said the account was defaulted in 1998.i told them that i kept all my account paperwork for the past six years but this is 14 years ago.i just keep getting demands for payment.
any advice would be appreciated

ignore it-not paying from 14 years ago wouldnt even affect your credit rating today as the debt was so long ago and the six years have passed. It would never be enforceable. It might be an Idea to call Littlewoods yourself and ask them about the account you had out of curiosity. I doubt they would be enforcing debts from so long ago-double check with them as...

If you dont have proof of settling the debt I imagine you will now have to settle the bill.
I thought that if the debt was not acknowledged i.e. you have made no payments and they have sent you no bills that the debt was unenforceable? I guess it depends on whether you have moved house over this time and whether they have been actively trying to chase you?

It's my opinion that, as any debt which you may have and is over 6yrs old, the claim for settlement is statute barred by the Limitation Act 1980.

Personally, I would just ignore the claim and not correspond any further with the Debt Collection Agency.

However, as I am not a Solicitor, perhaps one of AB's Legal Eagles will comment if you were to post in the Law section and draw attention to this thread and the personal opinions which I have given.

the six years just means it's statute barred. They can still ask you to pay it, still send you letters, still phone you up, they just can enforce it through the courts. And it only applies if you had no corrspondance with then for over six years about the debt, AND have no moved and failed to inform them
