Hello, I am just in the process of getting divorced, I recieve a medical pension (as I was disabled out of the Navy) and a war pension (as the condition was attributable to active serice). I recieve both every month, once we are divorced is she entiled to either of them?

I'm sure it's one of the things that is taken into account when making a settlement. Are you suing solicitors or just trying to agree to the arrangements between the two of you?

At moment we are just in discussion, my argument would be that during my 12 years in the navy we were only married for 4 years of that time, after which i left. And that the pensions were being spent whilst we were together.
Its not about what was spent and how long you were married, its about the total resource pot, current and future and how it should be shared. If you hang onto the pensions then you will have to give up something else.
After a divorce where the father must pay 15% of his pay in maintenance, is that 15% of nett pay, or gross, and as the payment varies each month (a downward spiral) can the estranged partner insist on seeing the pay slips or even get it taken out by his employer. Thanks..
