my husband wants to remortgage the house since we are now seperated and wants the house in his name can he do this without my consent

he could remortgage and give you half the value of the house less the existing mortagge settlement

Not if the house is in both your names. It will need both your signatures to remortage it.

but if you have children he can't make you homeless until they are 18

I have moved out into rental accomodation and our Daughter who is 16 with learning disabilites lives between the both of us.he says if i want anything from the house i have to have half the bills. i think it is very unfair.

It is also probably illegal, get a solicitor, they do free 15 minute consulations. he sounds a right git

If the house is still in joint names and your daughter still lives there you are still liable for half of the mortage payments. You are not liable for any of the other bills.

Thank you both for that, he thinks as he is paying for the mortgage it gives him the right to take my name off of it, i think he is doing this before he puts in for a divorce so i do not have any claim whatsoever

We split after 5 years of arguing and as my daughter has learning disabilities it was affecting her a lot, he has told me he wants a divorce as he does not love me but i am letting him file for it, as its not what i want.
