Hi there. I moved abroad 4 weeks ago and left my job halfway through April. I was PAYE at this job. I was paid on 1st May, one month into the new tax year. Before I left a filled out a P85 (http://www.hmrc.gov.uk/cnr/p85.pdf) in order to reclaim the tax i have paid this tax year as I won't be returning to the UK for the foreesable.

HMRC has written back to say that I should pay tax through a self assessment therefore I have to reclaim overpayments through self assessment, ergo I can't have my tax back until 2014.

Does anyone know if I can challenge this? I can't have paid through self assessment as I was PAYE!

Another thing i should point out is that HMRC has given me a non-resident landlord number in order that the rent we are receiving on my property is tax free, I don't know if this has any bearing.

Yes, thanks, I understand that. My issue is that I don't want to self assess in 12 months time, I want to reclaim the tax I paid in April now. I'm no longer a UK resident and wont pay any further tax this year so don't understand why I can't use the P85.
of course you can appeal!

Wanted to see what options I had before calling them. I'm sure most people know what a plethora of options there are on their voicemail system and it costs me £1.50 a minute to call!

I wonder if my husband had applied for the non-resident landlord number we would have this issue. There's nothing to stop him having the rent paid to him. Mmmm...
unless you get paid a massive amount, the money you have paid this tax year which it sounds like you only worked a handful of days of will be quite small. Is it worth worrying about?

Hi Bednobs. I was a commissioned salesperson and the tax I paid for April's payday was nearly £2000. So I don't really want to wait a year for it if I can get it sooner.
Geez, then by my reckoning you must have earned about £7k in that month.

No, I don't believe you can do what you are wanting to do. Reconciliation with HMRC occurs at the end of the tax year in question, so April 2014. HMRC have only your word for it that you won't have any further UK earnings under PAYE this tax year - you might decide to come back again.

Use this form to claim tax relief or a repayment of tax if:
• you have lived or worked in the UK
• you are leaving the UK, and you
- may not be coming back or,
- are going to work abroad full-time for at least a complete tax year

Hi - I'm just about to do the same thing.
I will be leaving the UK in September and not work in the UK for at least 3 years.
Been given a tax adviser via a well know company to assist me. He said if I fill in a P85, I would get a part way through the year refund.
The form also mentions about handing in my P45 with the P85.
I will not be receiving any other income in he UK this year.
We have a house sitter who will simply pay the bills , but no rent.
