Hi,

Not sure ifg this is business or law but will move it if it turns out to be a law question :)

If you hire out a venue for a function and the hirer has stated they will be providing their own catering via a third party, who is responsible for any damage caused by the cateres equipment being faulty (gas explosion of a bbq)?

The third party caterer is a professional caterer elsewhere but was only doing the catering 'as a friend' of the hirer and not in her professional capacity. The faulty equipment was from her employer and had been properly signed for by her.

Was insurance cover, and whose responsibility to obtain it, not stipulated in your contract?
What does it say in your hire terms and conditions?

I'm not sure of that at the moment but usaualy the caterer has to have insurance. We did ask for it but they didn't give it to us. It is obviously because it was just a friend doing a favour for them.

I'll have to check to see who gave her permission to put her stuff in the place she did.

We are a grade 2 listed building and a verander roof has been distroyed plus damage to other external fixtures and luckily two fire doors did the job they should have :) we would not have a building if it hadn't been for them.
