Basically there was fraudulent activity on my account - someone had accessed my card details somehow and were trying to buy stuff via my card which the bank blocked quickly thankfully. However they signed my card up for teeth whitening products from a company called GoWhite. Obviously because my card was blocked they never got paid but I never knew my card was signed up to this company as they never sent me any letters etc in regards to this. Now randomly one day I got a letter from this company demanding money for goods which they supposedly sent me - these goods have never arrived and are believed to be lost in the post. I thought this a scam so I ignored the letter and binned it, maybe foolish at the time I accept that but I wasn't in a great frame of mind. Suddenly a few weeks later a box of teeth whitening strips arrived with another demanding letter wanting more money. At this point I realized and sent the company an email basically explaining there was fraudulent activity etc on my account and I never ordered these goods and my bank will fully back me up on that. I told them i'm willing to send the box back to them, unused and unopened, out of my own pocket. They never replied. They only have an email for this company, no telephone number which makes it slightly harder to deal with. They never responded to my email so i thought the issue dealt with however only this morning I received another letter demanding £77.00 or they pass to a debt collection agency - I'm not willing to pay them when I never ordered these goods?? what are my rights and what can I do about this?

Just ignore it,even if they do send it to a debt collector ,just explain what happened and the debt collector will not continue with the case.
I seems odd doesn't it that a fraudster would have signed you up for this, but maybe it was linked to some sort of cashback deal.
Has your bank/card provider said they can't help on this?
It's probably better to write to them by registered post and keep a copy of your letter. I wouldn't even offer to post them back - tell them they are available for collection.
FF I looked GoWhite up on the internet and only found 2 companies with that name one in China and one in Australia !
You may need to prove to them the fraudulent activity. They probably get people trying to con them, I is very easy to say, so will not nessissarily believe you.

I found it just a little confusing and tjhe time line a bit wonky and it may be worth yous itting down and writing out a bare skeleton

um I pulled my original answer as it seemed pretty trite BUT
NO - THEY to show you contracted with them to enforce any debt and you do NOT have to disprove any statements from them . Basic Rnglish Law. So the basic requitement is they have to prove their case ( you have a contract you have broken ) and NOT you have to disprove their bare statement by proving a converse

You may once you have got the time line short and clear and sweet
write to them repudiating the contract
include the interesting bits from the bank copies and not originals (!)
and presumably it has been reported to the police


I did this with littlewoods - look I just havent ordered this stuff -
and they were very good and said oops you have three more accounts !

I think it would be nice to tell Teeth WHite that you have been the victime of fraud ....



it is very worrisome first time round
and then if it happens again,
you say o god this again .... but with much less angst

we had a good idea who had opened the fraudulent accts
but kept it to ourselves . as of course we had no proof
Ok not prove perhaps but anyone can say there was fraudulent activity on my account.

If they have the right name, the right address, the right bank details WHY should the business believe the op? They go to court with all the paperwork and the op has nothing.

If the op has proof of the activity and a crime number etc making the business aware of this would seem the best course of action. To sit there and say prove it just smacks of stupidity and possibly guilt.

It may not be the legal nessesity but by goodness it is the easiest first route.

erm no I said it not because I am stupid but because it is part of english law.

I have been cloned and it is a pain - but how do you 'prove' you have been cloned ? - all that happens is that you get dinged for transactions you have not agreed to and you say so.
I have to say Littlewoods were good - ToothGlo seem less so
