Is It Legal To Replace A Condemend Boiler With An Old One In A Rented Property

is it legal to move an old boiler into a rented property, the boiler recently has been condemned by the gas engineers who came out to fault it. My landlord got quotes for a new boiler and IS in the process of having the new boiler put into his house, and IS putting the old one into his rented property, he claims it is only three or four years old, however the gas fitters fitting it state it is more likely to be about eight to ten years old. This is not a theoretical questions it IS being fitted now. Is this legal as long as it gets a new gas safe certificate ? Or is this a definite no no with just money saving and bettering his own property installation off the back of the rented properties failings.
Whatever the answer I think it is disgusting, and is only a short term problem solved.
