How Long Of A Sentence?
My partner has pleaded guilty to malicious wounding with intent to cause gbh this is the first time he has ever been in trouble with the police, what do you think his sentence could be?
What happened was my 16 year old daughter has been harassed by a 26 year old man he tried to run her off the road while she was in her friends car and also chased them in his car. He sent threatening texts and previously sent her explicit texts. We reported this to the police but they never turned up until 8 days later. My partner had been to the pub had a few drinks (wasn't drunk) and said to me he wanted to go and speak to him as he had terrified my daughter and she even moved out of the area for a few days to keep out of the blokes way. I had told my partner if he does go to speak to him make sure someone goes with him as the bloke is dangerous he is also a well known thief who carries crow bars and whatever else in his car and is a druggie so be careful as I didn't know how he would respond. (no one ever confronts him).On route to going to confront him about his actions my partner picked up a bit of wood, when he confronted him he started making derogatory comments about my daughter so my partner hit him 3 times on the head. He required hospital treated and had staples in his head but was out the same evening and driving the next day. He handed himself in to police as he was ashamed of what he had done. He isn't a violent man at all and everyone can not believe what has happened. The solicitor has told us that he could get 12 years. We currently have police markers on our address and the bloke he hit has continued to follow my daughter in his car. Which we have reported, she now does not leave the house and has to be taken everywhere which I am finding difficult as I have another 4 children. Would all of the mitigating circumstances be taken into consideration or should I just prepare myself and my children for 12 years. Sorry if this seems all jumbled I'm just tryig to find out what my family could be facing. My partner has 15 excellent character references from his boss, doctors, people in armed forces etc not sure if this all helps.

Malicious wounding with intent is under Section 18.
From the guidelines the minimum sentence is 3 years and the maximum is 16 years. It is ALWAYS a prison sentence.

There is an automatic 1/3 reduction in sentence for an early guilty plea (as I told you in your original question)
But as the minimum possible sentence is 3 years in prison , the absolute minimum will be 2 years inside.
I personally don't see this as 12 years ,your solicitor says 'up to' 12 years. But I think he is just preparing you for the worst possible outcome. But as I just said, you have to accept that he will get at least 3 years,reduced to 2 for his guilty plea.
