Nightmare Tenants, Slum Landlords.

Does anyone watch this show? There was a landlord on this last night who was a complete moron. There was a woman who was renting his Mother's house and she had stopped paying the rent. She owed upwards of £9-10K so he went to court to evict her. When she was moving out etc, he spoke to her about the back rent and mentioned that as her sister was the guarantor on the account, he would go after her sister for the back rent.
If her sister was the guarantor on the account... why didn't he go after her for the rent whilst the woman was still living there???!! That is the whole point of having a guarantor for your rent. If you dont pay, they have to. Why did he let it get that far when he could have solved his issue by going after the guarantor for the rent.

For more on marking an answer as the "Best Answer", please visit our FAQ.The tenant is primarily responsible for paying the rent, so the landlord might have considered that the best chance of being paid in full would be to seek a judgment against the tenant and then go after the guarantor for any balance. If I were a rent guarantor, I would like to think that the landlord had exhausted all avenues against the tenant before coming after me.
I agree TonyV.. If I was more than 1 month overdue with my rent, I would expect the landlord to begin the eviction process. I dont understand how they can say that they are owed thousands of pounds because someone hasnt paid for 8 or 9 months but they are only now starting eviction proceedings.

The whole point of having a guarantor for the rent is so that you can guarantee that it gets paid every month. Ive had to have guarantors for my rent in the past and that is how the guarantor contract is written. If I didnt pay the rent, after 1 month, the money would be requested from the guarantor.

you have to keep on top of it
and chase after the first missed rent
not paying any rent at all ( missing the first payment ) is a terribly bad sign. and if you think - - well she might pay next month, double! then it allows you to do nothing ...
I tend to say - look if you get out then I wont chase for the rent - and if you stay I know where to go for the rent...
altho you must look on the funny side of eviction and putting mothers with small children on the street at night - - -
One had rung up her violent boy friend from whom she had fled (!) and he came around and kicked down the door and pulled the alarm off the wall .
and I said Look if you go I wont pursue for the rent which I know you dont have,
and she wept and said "Oh ! oh! this is the second time this year I have been evicted!" and I couldnt not resist commenting to her mother who was also in the room,
well if she keeps this up, she can cram in a third before the end of December
she went home to her vicar -father who later commented on er chucking her out:
I am a protestant minister - not a Roman Catholic saint ....
daughter of the manse - and as they say - a bit of a gal !

they think they can escape a CCJ - which it is believed is stuck on the address and not the name ....
I rang up one property manager and asked why they hadnt rung me, and got a really poncey reply - "we dont know who you are - and anyway we are not allowed to discuss our client with anyone" think AB and 'I really dont know WHAT you're talking about!'
and I said - I'm the one who has a CCJ against her - you know which is in the public domain - would you like a copy ?
and they said yes
her little feet didnt touch the floor that time - out in nine days. presumably they held up her application form and and said - filling it out and forgetting a CCJ is ..... fraud - since I was not then her Landlord I can only surmise .....
