I recently bought sum curtains from argos which cost me �45, brought them home they were the wrong size and ugly!, so i tried 2 fit them back in the packaging, it was impossible, i returned them the next day with the reciept and explained they would not fit back in the packaging, the lady told me u'll ave 2 try harder, so i did. i went home and tried and the packaging broke, so i rang customer services & they said there is nothing we can do. DOSEN'T THAT SEEM UNFAIR, THEY WERE PROBABLY PACKED BY MACHINE!

You should have measured your windows properly and bought the right size in the first place. Secondly, even if you could fit them back in the packaging, Argos do not have to give you a refund just because you think they are ugly!

CheekyChops is correct ~ by buying the curtains you entered into a contract, which can only be broken if the curtains were damaged or faulty..not because you have changed your mind!


Some stores will exchange items, or give credit notes. However this isn't an automatic right but just 'goodwill' & down to the discretion of the assistant or store manager.


Learn from your mistake, measure your window ~ & take your time choosing curtains in future :o)

When you say they were the wrong size, do you mean they were not the size stated on the packaging, or that you bought the wrong size by mistake?


If the first, then you are entitled to a refund for faulty goods, regardless of the packaging.


If the second then Argos are right, they don't have to do anything. The return in packaging is a concession - they don't legally have to do it but they do as a service to customers and they certainly don't have to extend it to without packaging.


The ugly bit is irrelevant.

No, they were 2 long, and they didn't look like the did in the catalogue, i will defenitly think twice before buying anything again and how *** u can return items to a catalogue if they are not to ur liking?

Also, remember that Argos will have to re-sell the item, so you can't return anything in a state that you wouldnt be willing to buy it in!

With all due respect you wouldn't have had to take them out of the packet to know they were ugly.

Argos do have a full return policy if the goods are in the original packing, this is as you say so that you can see things in the flesh when buying from a catalogue, but as I said you wouldn't have had to take them out to see they were ugly.

It doesnt matter how it was packaged originally. I have heard Argos employees saying that they will only accept goods in the original condition.

No shop has to give you a refund unless the item is faulty. The ones that do refund are doing you a favour in the interests of customer service, but they don't have to. Looks like you'll have to try ebaying them.

They do but there is changing your mind without opening the packet and then changing your mind having spent the last 14 days messing around with the thing.

Under the sale of goods act you can expect a full refund for goods that are not of merchantable quality or not fit for the purpose for which they were bought. The fact that you've taken a dislike to them is not a valid reason I'm afraid. Argos have a sensibly applied returns policy which is sadly abused, this may well be why you received such a rough reception in your local Argos.


They are under no obligation to refund or exchange anything that is out of it's original packaging or appears to have been used. It does largely depend on the store and more importantly, the temperament of the staff as to how well or otherwise your complaint is received.


I'd make them 'faulty' they'd have to refund your money then! I thought Argos had a 16 day money back garauntee anyway?

Satin7 I think the important word in the quote from the Argos site is "most" ie not all items are covered. One type of product not covered is the Freeview set-top box but I have no idea why-any suggestions? I can buy a tv, decide the reception is rubbish, take it back and get a refund but the same does not apply to a Freeview receiver, what's the difference.
THECORBYLOON, that's odd!? If the product is unused and in it's original packaging they should refund your money. However, I think if it has been plugged in and tuned I may have the answer. A colleague once told me (and he is in no way an expert, but does have a city and guilds certificate in TV repairing) That once you have tuned the box or attempted to tune it you can't re-tune it in a different location. You can re-tune it to update your channel package in the same location but couldn't take it round the corner, where the signal strength and direction might be slightly different, and get it to work. How true that is I don't really know but if it's a common misconception perhaps Argos believe it too.

this happened to my neightbour re the freeview box and they took it back to argos and were able to exchange it for other goods although they did state that they wouldnt be allowed a refund. As for not being able to retune freeview boxes, i gave my old one to my parents and they were able to retune it no probs.


As for the curtains well....

When I bought the set-top box, I was asked if I'd checked ma postcode to make sure I could get the reception because I'd not get a refund and was telt the same when I got one for a pal. I'll ring Argos one of these days and find out the answer when I'm bored....

He. People often mistake returns policies of stores with their consumer rights. Just to highlight a few points.

* You cannot return goods because you didn't like tem under the your legal rights, but you may be able to under the store policy

* You may return the goods as a legal right if the goods are not 'satisfactory' (Sale of Goods Act), not what they said it was (Missleading Advertisements - Consumer Protection Act)

You may also be able to return the goods outside of Statute law and in 'Breach' or 'Frustration' of Contract - would go into detail, but its late and i'm tired.

Suffice to say that for evey 1 protection that a store has in legislation, the customer has ten times that. You've just gotta look in the right places - given you a few above.
