Car park incident with trolley (part 2)
cont...
1) There was plenty of room between the trolley and the opposite parked cars for him to get passed they are wide aisles or he should have been patient and waited.
2) Just because their insurance wont cover it, they are trying to claim it was her fault to avoid them paying it
3) The trolley wasn't going anywhere as our items were still on it, not as though she pushed it away
4) How can they even assume home insurance will cover this?
My mom is obviously not going to pay for damages because as far as she's concerned (rightly so too I think), it was the driver's fault. He should have saw us unloading heavy long items from a trolley and left more room. What is my moms next action because obviously she doesn't want to go to any expense?
Thanks

She should check her home insurance policy and see if she has legal expenses cover. If so she should contact her insurer and see if they will take it up for her.
If she doesn't have cover she should reply in writing explaining the circumstances in full, with a diagram. If possible go back to the shop and reconstruct what happened so you can take measurements to show how much room the driver had to get past. Include this in the letter. Refuse to consider paying anything. Send the letter by recorded delivery and keep a copy. Hopefully that will be the end of it.
i also think it's a try on. if i'm reading your post right their car was moving not your trolley? sounds like fault is with the driver.
before involving your insurance company at all (which will may start the claim process on your record and have a knock on effect to your next premium) I would recommend calling your local Citizen's Advice Bureau. That's free advice and the local number will be in your phone book.
