I bought my new home nearly 2 years ago, I am thinking of remortgaging and have not yet registered it with land registry do I need to have it registered before I can remortgage?

I am 99.9% it was registered with the Land Registry within weeks of completion.

Sorry - 99.9% certain it was registered!

No it hasnt been registered as my solictor posted me a bill for �400 to get it registered.
You really should register it. This is from the Land Registry site:

Q. Is all land registered?
A: No. It is estimated that about 82% of all potential titles to property in England and Wales are registered. This percentage is steadily increasing. When certain transactions are made, such as a sale, application must be made to register the property otherwise the owner will not have full legal title to it. for you to have a mortgage the land must be registered - �400 seems very expensive though
but i think your house must be registered as it has been a requirement on purchase since 1998 i believe. see http://www.landreg.gov.uk/ where you can check whether it is registered or even self register i believe.

It is compulsory to register land (in England and Wales for certain) on transfer of Title and it has been for several years - more than 2 years for sure. Your solicitor would have known this and assuming he/she quoted you a price to effect your purchase, this should have been included in the price. I would be questioning why he didn't do it 2 years ago, and why he/she now thinks it warrants an additional fee for he/her incompetance. The actual Land Registry fee is about �40 - the rest is his/her assessment of time to fill them in. It would take less than an hour to do this.

As it stands at the moment., if you are certain you never had the property registered in your name, then it will still be registered in the previous owners' names so I would suggest you get it registered now!!


In reply to buildersmate re the fee for registering, it depends how much the property was purchased for as to how much the fee will be - you can actually pay anything up to about �750.00 for the Land Registry fee!

This is a new house on a development in N.I it has never been registered. I do know that from a previous new house that we bought our solictor included the registry in his fee. The acting solictor for our present house fee was very steep but on looking at it closer it does not mention registry. And I was posted his bill for land registry 2 years ago but thought that it must have been an error. My house back then cost us 95k do you still think that it would cost �400 to register it with land registry?
The above answers are for England and Wales. Things are done differently in NI. The Land Register of Northern Ireland is in Belfast tel 02890 251515 (www.lrni.gov.uk). Why not talk to them and get answers from those who know?
