A number of years ago my parents verbally offered to erect a garden fence in place of a cattle type fence (which was actually the neighbours responsibility), but my parents wanted it to be in keeping with their other two boundary fences. The neighbour consented. Now part of the fence has fallen down in the wind and the neighbour has said that it is not his responsibility as my father took responsibility when he erected the new fence. Is this correct?
Irrespective of what the Land Title says, it doesn't stop any neighbour deciding to put his own fence up on his side of the boundary. If that fence then falls down, its still his fence.
Don't involve a solicitor, please - it would be money for old rope.
