I booked a holiday with thomas cook online and submited my bank details. 1 week later i received a reciept for payment.
upon return from holiday i received a letter from thomas cook stating that their bank had failed to collect payment from me.Now they are threatening legal action to recover the money witch i no longer have available.

You are still liable to pay I'm afraid.

You must have known the money had not debited your account (holidays are not exactly cheap) and yet you still spent the money.
