second charge on house deeds

my father is trying to change his mortgage he had a second charge on the house before the halifax bought the mortgage from the leeds and the second charge holder, now that dad wants to change the new mortgage company say because there is a second charge on the dees from way back this has tobe removed but the bank in question no longer exsists dad is a discharged banktrupt from 12 years ago and the halifax have had thier mortgage for about 9 years they say the cant do anything but its holding the new mortgage up, how can my father get them to remove the second charge nobody wants to be resonsible??

I am sorry its not too clear - who is the second charge holder? If they are a bank were they taken over, and if so by whom?

the second charge holder was the greyhound bank they no longer trade as far as I can find out, but we donot have any paper work from them to say they released the charge to the halifax, when the halifax took over the leeds
You will have to make a statement of the circumstances in a form acceptable to the Land Registry to get the charge removed and at the same time arrange insurance cover for the amount outstanding over the period remaining on the 2nd charge in favour of the new mortgage provider just in case somebody turns up with a claim. You will need a solicitor who should also be able to find a specialist insurer for you. The Land Registry will charge �40, the solicitor �200-�250. It is not possible to approximate the insurance premium without fully knowing the circumstances but in should be in the very low hundreds.
