Ex Husband not paying agreed Maintenance amount...
0 Answers
Court Order made Aug 2007 for ex-husband to pay x per month maintenance. He has decided to only pay two thirds from now on, his parents were paying the difference but aren't any more. He owns his own house, he purchased from the council in 2007 after our Court Order was made for maintenance, lives a lifestyle which does not match his self employed salary on paper. I have referred to Magistrates, but he has to be 3 mths in arrears I understand before they will chase for money. Can I arrange a Charging Order on his house, can I force sale of house for a lump sum to support the children. I work 22 hrs a week, self employed bring in 350 a month. I went 50/50 on the marital breakup/assets. I am not a money grabbing ex just need to be able to support our three children (11, 9 and 5 yrs). He says he is behind on mortgage payments, has had bailiffs at his door for Income Tax debt. He lives with girlfriend & her 3 kids. She is still married. What can I do?
If I DO go back to Court, I have to prove he lives a lifestyle not matching his accounts, which will not be hard to do, but don't want to have to do this all over again.... is a Charging Order the simplest, or force sale of his house. Value 325k, mortgage of 110. He has plenty of equity, could pay me a lump sum - end of!
