Law on selling house after divorce (children involved)
My partner has been divorced for approx 12 months now and they completed their application personally without solicitors.
They mutually agreed that he would not claim half the value of their shared home as his ex wife lives there with their 2 children - 5 bedroom home --- 3 people living there. Part of the agreement was that this would carry on until she met someone else or started a relationship.
It has since come to light that this has happened with her but she is stating its just a friendship! We know otherwise. He has no qualms with this new relationship. The house was paid for over 10 yrs ago now so there is no mortgage. The property he has now bought with me gives us mortgage payments of over �800 per month.
All he wants to do is get his half of the house in monetary terms. Ive heard that the waiting til the eldest child is 18 yrs old no longer applies - is this correct. I know morally people may comment that he needs to think of the kids in respect of the house but she is more than capable of purchasing a similar house, slightly smaller, for them all.
