Comet charging 10% when you return goods

I took a xmas present back to Comet, it was a book reader & adaptor total £147 , as I queued to return I saw for the first time a big notice on the wall by the returns desk stating if you returned goods that had been opened you would be offered a full refund only if you accept a credit note but if you want your cash back they would deduct 10 %, which I thought was a cheek as the item had not been used, after demanding to see the manager I was given a full refund on the grounds that the item had been "miss sold" to me but it took me a long time to convince the manager etc.
How long has this been going on ? after having always bought at Comet, I will find somewhere else in future, nobody before me in the queue seemed to challenge this ruling.

Mollykins, the point that is being made is that the law gives a purchaser certain rights and the retailer also has certain obligations. If a product is not faulty, has been correctly described and is fit for pupose, the retailer is not obliged to give a refund. If a size 12 whatever has been correctly labled as a size 12, then it is too bad if the purchaser decides later that it does not fit. Many retailers will give credit notes in exchange or a full refund but the point is they do not HAVE to.

this is what happened, I did not put at first but my husband is reg blind, he is an avid world news listener and heard there was a new gadget that u could download 300 books on for spoken word, we went together and bought a Sony E Book reader + an adaptor for charging, the salesman new he was blind and what he wanted it for but when we got it home and read the manual thus having to open the box,it could download the books but it was not spoken word and as he is no longer able to read it was useless for him. When the sales guy saw me come to return he scarpered, so he must have known.Thats hwy the manager agreed it was miss sold.
joko is quite right.......this is why, for many years, M&S was so popular because they would give no questions asked refunds.
I was impressed by Argos......I bought completely the wrong thing on-line as a gift but luckily found out before Xmas day.............I rang Argos, they have given me a full refund, and haven't charged me for returning the item.

I sell Sony e readers at work and the packaging is easily opened and easy to close again, they were of course not legally bound to give you a refund if it was ust unsuitable, but of course it was miss sold, however, if comet clearly display their returns policy and an element of that policy is factored in to include opened packaging and any potentioal loss on re-sale they are within their rights to charge for that.
