I paid £150 deposit via debit card to a car dealer who gave in writing that it was refundable if for any reason I was not happy with the car. after a rude email from the delear I decided not to purchase the car and asked for a refund. after no contact for a few days I sent an email stating the legal actions i would take to recover the money, when i got home there was a telephone message to ring the dealer, I did so but after asking if the dealer would refund my deposit he began to swear shout and say some nasty things to me; "he said he could sue me for the full ammount" and " that I had lost my deposit" . The dealer then put the phone down. 1. can the dealer sue me for the whole ammount ? 2. Am I entitled to get my deposit back thanks? 3. if so can I also claim the expenses to do so from the dealer. thanks

does it say in writing that you can have your deposit back even if you just decide to cancel order?

if it does then write to dealer giving 5 days to refund the money. State that you shall take it to the small claims court if they do not refund.

Obviously you have to be sure that what they put in writing stands for you changing your mind.
As long as the car wasn't damaged - I don't see why you can't have your deposite back. Go to the citizens advice, i'm sure if the car WAS damaged he'd sue you for it. this might make interesting reading for you:

As long as you have a contract that you can cancel and how to do it then you should get your money back.

Start a small claim throught the courts. It doesn't cost much and will give him a sharp shock.
but there was nothing wrong with the car...you just changed your mind...that wasnt the deal

whats the point of as deposit if they have to give it back for any reason...
