hi can anyone tell me my partner has a son from a previous relationship who is 5. we would like to take him to spain with us in may but his mom is saying no. she takes him abroad but wont let his father. what rights does his father have

Your partner can take his son out of the country without the other parents permission as long as it is for no longer than a month.
Of course this all depends on certain factors:
A) Was your partner married to his ex?
or
B) Does he have legal parental responsibility for his son?

I wouldn't let my ex take my son away either. And we get on really well. I had my son with my x with the intention to be together always, but he left and I am glad it went that way as my partner now is amazing. But my son is 9 and noway do I want him somewhere I don't know, not yet, I feel he is too young. No-one loves a child like a mother, its carrying them for 9 months I guess and although I believe men should do their bit and pay heir way, if its the mum who is the full time carer then she should have the final say.
When my son is 12 then his dad can take him where he wants. But he is too little i feel.
The mum of this 5 year old obviously has fears... they should be taken into consideration. She may take him away but she is with him all the time.
I don't care what people think of me, or my ideas of parenting. All I know is that my ex has taken my son on holiday in the uk, and can every year if he likes, but not another country.....

hi megal, the problem is she wont let us take him in this country either. yeah i do have kids and it would be hard but at the same time if my kids wanted to go then i would allow it. i may not know where there are but i know they are with there dad and are safe. he always asks why his brothers are going on holiday and not him, how do you explain that to a 5 year old.
