My friend & her live in partner decided to split up 4 months ago. The council house they shared only has his name on the tennancy, but he said she could stay there till she found a home for her & her children. It all came to a head last week ahen his family came round & insisted she leave, but they wouldnt let her take the kids with her, she rang the police & they said because of the time of night it was to leave the kids there for the night. Since then my friend has visited her kids daily & wants to have them with her. Legally has she got a right to take the kids? His name is on the birth certificate but he hasnt got a residence order. There are no Agencies involved in this case. We just want to know what her rights are.

Is he refusing to let her have the kids?

Has she got somewhere suitable to live now?

no he lets her see them but only at his house. At present she is staying at her sisters flat, where she can be assessed for her own property with the kids.
Has he said that she can't have them when she's housed?

She'll have to make an appointment with a family law solicitor. Does she work?
It might be a good idea to repost this question in law.
