my partner is the respondant in a divorce petition. This has been going on since feb 2009 and is no further forward as the applicants solicitor made a mistake on the divorce papers. The applicant is paying the court fees. On the original petition the grounds for divorce were 2 years separation. It took the applicant months to actually have the affidavit witnessed but eventually she did. All the papers were sent off to the court at long last then we discover the applicants solicitor marked the wrong box instead of ticking the 2 year sep this time she accidentally ticked the 2 year desertion. This has now costs my partner £400+ in his solicitors fees for having to do extra paperwork, which if the applicants sol had not made the error this would not have had to happen. Would it be possible for him to claim these costs back from the applicants solicitor through her negligence?
