My son and his partner have a 1 yr old son, they are not married. The thing is,her mother wants to move to southern ireland and is encouraging her to go with the baby, he does not want to go. How does my son stand legally - his name is on the birth cert. HELP

Unfortunatelly, it is up to the mother of the child. 'Fathers with children born after 1 December 2003 and whose name appears on the birth certificate have parental rights and responsibilities.' But the Court is yet to separate a child from its mother without a good enough reason and she is within her rights to move if she wishes.


If your son's relationship is strong then I suggest try and leave it for them to sort out. Trust the mother to make the right decision, it can't be that easy for her either. And if she should decide to move then you can try and contact the solicitor to work out the details. But don't over react just yet.
