How long of a sentence for two counts of gbh?

My estranged husband is due in crown court on september 21st on two counts gbh wounding which he has plead guilty, and gbh wounding with inent oh he has plead not guilty. I have not had contact with him since this date as his bail restrictions are so strict he has been banned from town I love or contacting me or my partner.

On may 29th he came into my home and attacked my partner with a hammer, I was in bath he cornered my partner between toilet and wall so he had no chance to defend himself and all this done while our four year old was in next room, he made two phone calls prior that day stating he was going to put him in hospital, came to the home eariler that afternoon ( I asked my partner to leave before he came ) asking to see our son but was only around to see if my partner was there.

Now my husband was only expected to have the gbh wounding carried as he has no previous convictions however the judge has carried both counts so myself and my partner have to give evidence regarding the matter. My husband admits to bringing the hammer but denies using it, he disposed of it afterwards and only admited to police after heavy questioning and as it had been raining steady all dna was wiped although 3 blood hounds detected blood on the hammer and area of his car where he threw it after leaving property.

My partner had to have his head glued together and was black and blue and had I not managed to get inbetween him and my husband he would have killed him. Now the trial is expected to last for one to two days? What sort of sentence would you expect him to recieve? Would it definalty be custodial and if so how long? Hes stopped paying all his bills including hs pride and joy his car so Im wondering if his solicitor has rtold him he is going to jail??

He's lucky he's not facing a murder charge. He'll get a custodial sentence, but I don't know how long.

the detective wanted to use dogs in as he knew my husband was lying and as the hammer was lying in grass with heavy rain for a few days all had more or less been washed away however they also retrieved gravel from my partners head that matches the crap on hammer ( it was his fathes and hes a plasterer )

bloodhounds are good for tracking a scent.. finding missing people, etc.

not sure what use they would be at sniffing a hammer, unless they can make a Sect 9 Witness Statement with their findings when they're done.

Or even more hopefully they will listen to the evidence presented to them, be guided by the judge on points of law, and reach their verdict on that basis !!

Sentences for GBH with intent are on page 5. Sentences for GBH are on page 8. The sentences there refer to a first-time offender convicted after a trial.

Your description of the events puts the offence into at least 'Category 2' so, if your husband is convicted of GBH with intent a sentence of between 5 and 9 years imprisonment is likely. At least half of the sentence would actually be 'inside' but it could be up to two thirds. So he's likely to be in prison for between 2½ and 6 years. (A rough guess would be a 6 year sentence, with between 3 and 4 years actually being spent in prison).

Wounding with intent is only 1 step down from 'Manslaughter' . I would expect he will get around 5 years . DEFINATELY CUSTODIAL !!!
