Removing biological father's parental rights.

The biological father of my sisters daughter has had no contact since she was 2months old and is now 21 months old and has never paid a penny for her. How would she go about removing his parental rights and signing them over to me as she is concerned if anything happened to her he could turn up n take her and none of her family would have a say in it.

For more on marking an answer as the "Best Answer", please visit our FAQ.The birth Mother is awarded parental responsibility automatically as is a person with a residence order, the Father would have parental responsibility if married to the Mother or if the child was born after 01-12-2003 (which in your case the child was) and he was named on the birth certificate. The Childrens act defines parental responsibility as “all the rights, duties, powers, responsibilities and authority which by law a parent has”. If he is not named on the birth certificate and the birth was before 01-12-2003 he would have to re-register the birth if no one else is named as the Father, make a formal agreement with the Mother, or apply to the court for PR.
